South Dakota Small Estate Affidavit
South Dakota runs two lanes in the same part of the code, with different caps, different value bases, different waits, and different channels. The personal property lane under section 29A-3-1201 tests the entire estate at 100,000 dollars after 30 days and is presented to the holder. The real property lane under section 29A-3-1203 tests the decedent interest in South Dakota real property at 50,000 dollars after 60 days and is filed with the register of deeds.
The two lanes, never merged
South Dakota runs two affidavit lanes on two caps, two bases, two waits, and two channels. They were created and amended by two consecutive 2022 session laws, and the pair must never be collapsed into one limit change sentence. SL 2022, chapter 88 amended section 29A-3-1201 and doubled the personal property cap. SL 2022, chapter 89, House Bill 1115, added section 29A-3-1203 as a new section and amended section 7-9-7 on register of deeds acceptance. The chapter 88 enrolled text was not extracted for this guide, so no bill number and no effective date for chapter 88 is stated here. Before 2022 there was no section 1203. Any pre-2022 real estate affidavit statement is either the joint tenancy affidavit under section 21-44-2, a different instrument, or an import from another state.
Lane 1: personal property (section 29A-3-1201)
Thirty days after death, a holder of tangible personal property or an instrument evidencing a debt, obligation, stock, or chose in action shall pay or deliver to the claiming successor on presentation of the affidavit. The affidavit, made by or on behalf of the successor, must state five things: the value of the entire estate, wherever located, less liens and encumbrances, does not exceed $100,000; 30 days have elapsed since death; no application or petition for the appointment of a personal representative is pending or has been granted in any jurisdiction; the decedent has not incurred any indebtedness to the Department of Social Services for medical assistance for nursing home or other medical institutional care; and the claiming successor is entitled to payment or delivery of the property.
A transfer agent of any security shall change registered ownership on the books of the corporation on presentation of an affidavit under the section. The section states no court filing, no decree, and no letters. Absences are findings, not gaps. Section 1201 states no notarization, no oath wording, no death certificate attachment, no prescribed form, no bond, no creditor notice, and no filing. Importing any of them from a sibling state or from section 1203 fabricates the procedure. Real property is outside this lane. The affidavit reaches personal property and instruments only, and section 1203 exists precisely because this lane cannot transfer real estate.
The Department of Social Services statement is a bar, not a formality. It is the fifth statement where the Uniform Probate Code template carries four. The Department own Estate Recovery page inverts the same affidavit for its own use. See the Department of Social Services mirror below.
Every pre-2022 secondary and every vendor form still stating $50,000 for this lane states dead law. The $50,000 figure for section 1201 died with the 2022 doubling. Vendor forms also carry two statements that are not in current section 1201: a copy of the affidavit will be furnished to the Department of Revenue with inheritance tax paid, and an itemized property and claim list in the form own numbering. The inheritance tax limb is a pre-repeal carryover. Whether any current statute or rule still requires furnishing a copy to the Department of Revenue was not confirmed for this guide, and no sentence here states it.
Effect of the personal property affidavit (section 29A-3-1202)
The holder who pays, delivers, transfers, or issues under the affidavit is discharged and released as if dealing with a personal representative, and need not see to the application of the property or inquire into the truth of any statement. A holder who refuses may be compelled. The property may be recovered in a proceeding by or on behalf of the entitled persons on proof of the facts required to be stated. The recipient is liable and accountable to any personal representative or any person having a superior right. The holder discharge is not the recipient discharge. The affiant must see the property applied to liens and encumbrances, homestead allowance, exempt property, family allowance, funeral expenses, expenses of administration, and creditor claims, as required by law, with the remainder distributed to heirs and devisees entitled to it. The affiant submits personally to the jurisdiction of South Dakota courts in any proceeding relating to the affidavit instituted by any interested person. The section 1202 text read for this guide was a 2020 republication with a history ending in 1995. An official current re-read was not completed, and no post-1995 amendment is confirmed or ruled out. See the Source section.
Lane 2: real property (section 29A-3-1203)
Sixty days after death, a successor to the decedent interest in South Dakota real property may file an affidavit, plus a certified or authenticated death certificate copy, with the register of deeds in all counties where the real property is located. All claiming successors, or parties legally acting for them, shall sign. The affidavit is prima facie evidence of the facts included.
The affidavit must state ten things. First, the $50,000 real property interest cap, with the valuation split below. Second, 60 days elapsed. Third, no personal representative application or petition is pending or granted anywhere. Fourth, entitlement because of the homestead allowance under section 29A-2-402, the family allowance under section 29A-2-403, intestate succession, or devise under the will. Fifth, if succession is by will, investigation made and no subsequent will determinable. Sixth, no one other than a claiming successor has a right to the interest. Seventh, each successor relationship to the decedent and the value of the entire estate. Eighth, the transfer is not subject to a transfer fee under section 43-4-22(18). Ninth, no Department of Social Services indebtedness, in the same wording as section 1201. Tenth, each maker swears or affirms all statements true and material and acknowledges criminal penalties for a false statement.
The value test keys to the decedent interest in all real property located in this state only: $50,000. The value of the entire estate is a disclosure item in statement seven, never the test. A build stating a $50,000 entire estate test for this lane, or a $100,000 real property test, misstates both lanes.
Valuation splits by classification. Non-agricultural property is valued as shown on the assessment rolls for the year of death. Agricultural property is valued at fair market value on the date of death. The introduced draft of House Bill 1115 valued the interest from the assessment rolls less real estate taxes and interest due at death. The enrolled text uses the split above. Use the enrolled split only. Never carry the introduced wording.
The successor has the same protection and liability as a distributee who received a deed of distribution from a personal representative under section 29A-3-908, subject to section 29A-3-901. The successor must apply the property to the same list stated in section 1202(d). A good faith purchaser or lender for value without actual notice takes title free of estate claims and incurs no personal liability whether or not the transfer was proper, with no duty to inquire. Nothing in the section affects a secured or judgment creditor rights or lien enforcement. No dollar figure for the homestead allowance or the family allowance is stated here, because those sections were not opened. The scope of the transfer fee exemption in section 43-4-22(18) was not opened either, and no scope beyond the section own words is stated.
Register of deeds acceptance (section 7-9-7)
No register of deeds may accept for record any deed, joint tenancy or life estate affidavit, oil, gas, or mineral lease, or section 1203 succession affidavit that lacks grantor and grantee names, joint tenant names, the grantee or lessee post office address, and a legal description. Any deed or contract for deed dated after July 1, 1988, or any section 1203 affidavit, used in a purchase, exchange, transfer, or assignment of an interest in real property, must be accompanied by a certificate of value stating buyer and seller names and addresses, legal description, actual consideration, buyer seller relationship if any, and payment terms if other than payment in full at time of sale. A transfer on death deed under sections 29A-6-401 through 435 is exempt from the certificate of value requirement. The certificate of value duty is an acceptance condition on the filing, not a statement inside the section 1203 affidavit. The recording fee for a section 1203 affidavit was not opened, and no fee figure is stated here.
The Department of Social Services mirror
The Department of Social Services administers Estate Recovery under SDCL 28-6-23. Any medical assistance payment for an inpatient in a nursing facility, intermediate care facility for individuals with developmental disabilities, or other medical institution is a debt due to the Department. So is any payment on behalf of a person 55 or older for nursing facility, home and community based, intermediate care facility for individuals with developmental disabilities, hospital, and prescription drug services. The Department is itself entitled to receive personal property by presenting an affidavit under section 1201 plus a statement of its indebtedness for those services. A holder aware of such indebtedness may make no payment or delivery, except funeral expenses, unless the Department is paid first or has issued satisfaction of indebtedness under section 29A-3-817. The Department may submit its affidavit 30 days after death. Family members may request an extension to cover funeral expenses.
Two wording traps matter. The Department page says it may only claim on estates less than $100,000 when using the affidavit process. Section 1201(a)(1) says does not exceed $100,000. At exactly $100,000 the wordings diverge. This guide states the statute wording for the successor affidavit and the Department wording only for Department claims. No recovery applies if the recipient has a surviving spouse or a surviving child under 21 or meeting the Supplemental Security Income blind or disabled definition. Recovery against a surviving spouse estate is separately authorized, with a petition to limit under SDCL 28-6-23.1 on a Department form within six months of the recipient death. Section 29A-3-817 text was not opened, so satisfaction mechanics, issuer, and timing are not stated here.
Death certificate
The South Dakota Department of Health, Vital Records, charges a $15 search fee for all certificates requested. The fee is non-refundable if no record is found, and a Notification of Records Searched issues. Certified records may issue to the registrant, spouse, children, parents, guardian, next of kin, or authorized representative. Proof of relationship may be required. Requests may be made in person, by mail, online, or by phone. Mail goes to the State Office at 221 West Capitol Avenue, Pierre, SD 57501, or any Register of Deeds. A mailed application must be signed before a notary or accompanied by a clear photo identification copy. Phone and online orders go through VitalChek Network, Inc., the only authorized third party vendor, with a $6.50 VitalChek fee plus a $5.00 expedite fee for regular mail, or $17.50 for UPS Next Day, for totals of $26.50 and $44.00. One expedite fee applies per order, and each additional record adds $15. Copies cannot be faxed or emailed. Whether a Register of Deeds issued copy satisfies section 1203 certified or authenticated copy language was not confirmed, and this guide states the section own words and does not equate the two.
Forms
No official Unified Judicial System section 1201 or section 1203 form was found or opened for this guide. Section 1201 prescribes no form and states no filing, so a holder presented affidavit on the successor own paper is the statute own procedure. No vendor form is presented as the official form. The vehicle title transfer after death lane was not opened at all, and no procedure, form, or fee is banked for it. Informal probate, transfer on death deeds, and the joint tenancy termination affidavit are named only in this guide. None of their procedures, tests, or fees is stated.
