Virginia Small Estate Affidavit

Virginia runs three lanes, and they must never be merged: a $75,000 affidavit lane requiring all known successors after 60 days, a $35,000 no-affidavit lane after 60 days, and a 30-day funeral-establishment lane capped by the priority amount in § 64.2-528. Real property is excluded from every lane. The affidavit goes to the holder — no court filing, clerk, or fee appears in the Act's text.

Definitions first (§ 64.2-600)

A small asset is an indebtedness or asset belonging to or presently distributable to the decedent, other than real property, with a value at death of no more than $75,000 — including bank, savings, and credit-union accounts, brokerage accounts, securities, deposits, tax refunds and amounts overpaid, tangible personal property, and instruments evidencing a debt, obligation, stock, or chose in action. A successor is a person other than a creditor who is entitled to the asset under the will or by intestacy. A designated successor is designated under § 601(A)(7) and carries the fiduciary duty stated there. Real property is excluded from the definition and from every lane below.

Lane 1: the affidavit lane (§ 601(A)) — $75,000, all successors, 60 days

The holder shall pay or deliver on an affidavit made by all known successors stating all eight matters:

  1. The entire personal probate estate at death, wherever located, does not exceed $75,000.
  2. At least 60 days have elapsed since death.
  3. No personal representative application is pending or has been granted in any jurisdiction.
  4. The will, if any, has been duly probated.
  5. The claiming successor's entitlement and its basis.
  6. The names and addresses of all successors, to the extent known.
  7. The designated successor or successors.
  8. The designated successor's fiduciary duty.

The affidavit goes to the holder. A transfer agent shall re-register securities on presentation (§ 601(D)). A designated successor may endorse and negotiate checks, drafts, and instruments, and an accepting financial institution is discharged (§ 601(E)). Where a successor is incapacitated or disabled, § 601(B) provides discharge routes — direct payment or application, conservator or guardian, UTMA custodian or custodial trustee, adult relative or caregiver, or a separate fund subject to a withdrawal right. Virtual representation under §§ 64.2-714, 64.2-716, and 64.2-717 applies under § 601(C).

Lane 2: the no-affidavit lane (§ 602) — $35,000, holder's choice, 60 days

Where a small asset is $35,000 or less, the holder may pay or deliver to any successor, with no affidavit stated, provided 60 days have elapsed and no personal representative application is pending or granted. The differences from Lane 1 are the whole point: a lower figure, no affidavit, and a permissive "may" instead of a mandatory "shall." Section 602(B) states a fiduciary duty on the designated successor; carry its wording as written and invent no designation step for this lane.

Lane 3: the funeral lane (§ 604) — 30 days, funeral establishment, § 64.2-528 cap

At 30 days — not 60 — where no personal representative application is pending, granted, or expected, the holder shall, at a successor's request, pay a licensed funeral service establishment up to the amount given priority by § 64.2-528, on the establishment's affidavit stating its identity and address, the § 528 amount or the amount due less other payments, evidence the holder has the asset, and the successor's written representation on the 30 days and the no-representative position. The establishment is answerable to a later personal representative or superior successor. A good-faith refusal bars damages in this lane — a carve-out absent in § 603, never to be carried across. The § 64.2-528 priority figure is stated by reference only in this guide: the section was not read for this build, and no dollar figure is carried for it.

Effect and remedies (§§ 603, 605)

A holder that pays or delivers on a compliant affidavit is discharged as if dealing with a personal representative and need not inquire into the affidavit's truth. Refusal is met with recovery or compulsion plus damages on proof of a rightful claim. A recipient is answerable to a later personal representative or superior successor. Remedies under the Act are additional, not exclusive (§ 605).

What this guide does not state

No court filing, clerk, or fee is stated, because none appears in §§ 64.2-600–605. No Executive Secretary form is named, because the form the Act references is prepared by the Office of the Executive Secretary of the Supreme Court of Virginia and no form number appears in the text — county affidavit PDFs are not the official form. No raised-from history is stated: the 2025 c. 148 and 2026 c. 40 amendment effects were not read, and the chapter must be re-read live before any history is asserted. The motor-vehicle transfer rule in § 606(B) and § 46.2-634 is adjacent and ungrounded for this guide and is not included.

Open flags: (1) the § 64.2-528 priority figure was not read — stated by reference, no dollars; (2) the 2025 c. 148 and 2026 c. 40 amendment effects were not read — no raised-from history stated; (3) the current Executive Secretary form was not located live — county PDFs are not the official form; (4) the designated-successor wording of § 602(B) is carried as written; (5) § 606(B)/§ 46.2-634 motor-vehicle transfer is adjacent and ungrounded, excluded here.
