Small Estate Waiting Period Checker
Pick a state and enter the date of death. This checker computes the earliest date for each waiting period that runs from death, and states the clock basis. Some waits do not run from death, and some states state no wait at all. Those are stated in words, never invented.
Check the waiting period
Pick a state and enter a date of death.
How to read the result
- The result shows every lane. A state with two lanes shows both waits. West Virginia shows 30 days for a will-nominated affiant and 60 days for everyone else. Arizona shows 30 days for personal property and six months for real property.
- Some clocks do not start at death. Publication, mailing, order, and notice clocks start later. The result states the clock basis for each lane so the computed date is not mistaken for a filing date.
- No wait stated means no wait stated. Hawaii, Kentucky, Ohio, Maryland, and New Hampshire state no death-date waiting period in the cited sections. The checker says so in words instead of inventing a number.
- Open the state guide before acting. The state directory links every guide. A checker result is not a filing decision.
